What are considered places of public accommodation?
A space of public accommodation means a business, or an educational, refreshment, entertainment, or recreation facility, or an institution of any kind, whether licensed or not, whose goods, services, facilities, privileges, advantages, or accommodations are extended, offered, sold, or otherwise made available to the public.
Examples include retail stores, rental establishments, government buildings, and service establishments as well as educational institutions, recreational facilities (such as gyms), service centers, establishments and facilities that offer food and beverage not for on-premises consumption, including grocery stores, markets, convenience stores, pharmacies, drug stores, and food pantries, other than those portions of the place of public accommodation.
What are not considered places of accommodation?
Health care facilities, child care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities; crisis shelters, soup kitchens, or similar institutions; restaurants and food courts inside the secured zones of airports.
When do customers need to wear a face covering while in a place of public accommodation?
Customers must wear face coverings other than when seated at a table with at least 6-feet of social distance from other patrons, utilizing an established workout station with at least 6-feet of social distance between other patrons, and seated at any other assigned seating or destination inside an indoor venue that is a place of public accommodation as described within this ordinance.
How will public safety enforce this ordinance?
Public safety plans to ask for voluntary compliance. If there's non-compliance, there's potential a citation may be issued. Individuals found in violation may be cited for an ordinance violation. A business would be subject to administrative penalties.
A process will be developed for repeat violations for establishments and patrons. Businesses may request public safety to work with them for trespass violations.
